Terms of Use
1. Agreement
These terms are an agreement between you and Delta Maps (“Delta Maps”, “we”, “us”). They apply to the Delta Maps website at deltamaps.app, the Delta Maps iPhone app, and the services behind them (together, the “Service”).
By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who can use Delta Maps
You must be at least 13 years old to create an account. If you are under 18, a parent or guardian must agree to these terms for you.
Keep your sign-in details private and tell us at support@deltamaps.app if you think someone else is using your account. You are responsible for activity on your account. One account is for one person.
Delta Maps is in beta. Access is by invitation, and features, coverage, and prices can change while we build the product.
3. Map data is for planning, not permission
Property lines, owner information, public land, hunting areas, regulation zones, trails, contours, imagery, and other layers come from government records and other third-party sources. They can be incomplete, inaccurate, or out of date. They are not a survey, and they do not show who may legally hunt or enter a piece of ground.
You are responsible for your hunt. Before you enter land or hunt, confirm landowner permission, public-land rules, seasons, licenses, legal hunting hours, and every other law and regulation that applies to you.
Scent Drift, Wind Drift, weather, first and last light, and elevation figures are estimates. GPS positions can be off, and offline data can be stale. Do not rely on Delta Maps as your only means of navigation or in an emergency. Carry a backup, and tell someone where you are going.
4. Your content
You own the waypoints, lines, areas, tracks, photos, notes, journal entries, and files you add to Delta Maps (“your content”).
You give us permission to store, copy, process, and display your content only as needed to run the Service for you: to sync it between your devices, back it up, show it to you, and show it to the people you choose to share it with. This permission ends when you delete the content or your account, except for copies that other people already received from you and backups that expire on their normal schedule.
Only add content you have the right to add. Do not upload content that is unlawful or that invades someone else’s privacy.
6. Owner information
Signed-in users can see landowner names and parcel details from county property records. Use this information only for lawful purposes, such as identifying who to ask for permission.
Do not use it to harass, stalk, or threaten anyone, to send marketing, or to build lists for resale. Delta Maps is not a consumer reporting agency. Do not use any Delta Maps data to decide someone’s eligibility for credit, insurance, employment, housing, or any similar purpose.
7. Acceptable use
Do not:
- use the Service to break the law, including trespass and hunting laws;
- scrape, bulk-download, resell, or redistribute map data, tiles, or owner information, or use them to build a competing product;
- get around sign-in, access limits, or other security measures;
- reverse engineer the apps, except where the law allows it;
- interfere with the Service or place an unreasonable load on it;
- share your account or impersonate someone else;
- upload malware or content you do not have the right to share.
8. Subscriptions and billing
Delta Maps is free during the beta. If we offer paid plans, we will show the price and these terms before you choose one, and you will not be charged unless you do.
Paid plans will be sold on the website, not in the iPhone app, through a payment processor that handles your card details; we do not store card numbers. If you choose a paid plan:
- It renews automatically each month or year until you cancel.
- If your plan starts with a free trial, we ask for a payment method at the start. The trial converts to a paid plan when it ends unless you cancel before then.
- You can cancel at any time from your account’s billing page. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Payments are not refundable for partial periods, except where the law requires a refund.
- If a price changes, we will tell you in advance. The new price applies from your next renewal.
- Prices do not include taxes unless we say so.
Access codes and promotional access may expire, have no cash value, and cannot be transferred.
9. Third-party services
The Service uses maps, imagery, weather, and records from third parties, such as Mapbox, the National Weather Service, and state and county agencies. Their data can change or become unavailable, and some of it is provided under their own terms. We are not responsible for third-party websites that the Service links to.
10. Our rights
The Service, including its software, design, map styling, and the way we compile and present data, belongs to Delta Maps or its licensors. We give you a personal, non-transferable, revocable license to use the Service under these terms. If you send us feedback or ideas, we can use them without any obligation to you.
11. Ending your use
You can stop using the Service at any time, and you can delete your account in the app under Settings, Account. Deleting your account deletes your content as described in the Privacy Policy.
We can suspend or close an account that breaks these terms, puts others at risk, or exposes us to legal liability. Where we reasonably can, we will tell you first and give you a chance to export your content.
12. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, fitness for a particular purpose, and non-infringement. We do not promise that the Service or its data will be accurate, complete, uninterrupted, or free of errors.
13. Limits on liability
To the extent the law allows, Delta Maps is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or opportunities. This includes fines, citations, trespass claims, injury, or loss that results from reliance on map data, forecasts, or estimates.
To the extent the law allows, our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50.
Some places do not allow these limits. Where that is the case, they apply only as far as the law allows.
14. Your responsibility to us
If someone makes a claim against Delta Maps because of your content, your breach of these terms, or your violation of a law or of someone else’s rights, including trespass, you agree to cover the reasonable costs of that claim, to the extent the law allows.
15. Apple App Store terms
If you use the Delta Maps iPhone app, these points also apply:
- These terms are between you and Delta Maps, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app does not meet an applicable warranty, you can notify Apple, and Apple may refund any purchase price. Apple has no other warranty obligation for the app.
- Delta Maps, not Apple, is responsible for claims about the app, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims.
- You confirm that you are not in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
16. Changes to these terms
We may update these terms as the Service changes. When a change is material, we will tell you in the app or by email before it takes effect. If you keep using the Service after the change takes effect, the updated terms apply. The effective date at the top shows the current version.
17. Contact
Questions about these terms: support@deltamaps.app. If you have a dispute with us, contact us first. Most problems can be solved quickly and informally.
